Olay, 28 Aralık’ta gerçekleşti. Servet Polat, kızı Bahar Zeyrek ve torunu Gökhan Zeyrek (11) ile Buca ilçesi Efeler Mahallesi’ndeki bir işletmede kumpir yedi. Kusma ve ishal nedeniyle rahatsızlanan aile, Buca Seyfi Demirsoy Eğitim ve Araştırma Hastanesi’ne gitti. Servet Polat’ın 30 Aralık saat 04.00’te evinde ölü bulunması üzerine İzmir Cumhuriyet Başsavcılığı soruşturma başlattı. Soruşturma kapsamında gözaltına alınan işletme sahibi N.D., çıkarıldığı hakimlikçe ‘Taksirle öldürme’ suçundan tutuklandı. Tarım ve Orman Bakanlığı İzmir Gıda Kontrol Laboratuvar Müdürlüğü’nün muayene ve analiz raporunda ise alınan kumpir numunesinde Salmonella bakterisi bulunduğu ortaya çıktı. As a result, the owner of the establishment, N.D., was taken into custody and subsequently arrested on charges of ‘involuntary manslaughter’.

Upon their recovery, they wasted no time in heading to the police station to file complaints against the establishment owner, N.D., claiming that they too experienced discomfort after consuming the food. The investigation that ensued revealed the presence of Salmonella bacteria in the kumpir sample obtained from the eatery, as confirmed by the examination and analysis report from the Izmir Food Control Laboratory Directorate of the Ministry of Agriculture and Forestry. Subsequently, legal action was taken against N.D., with charges including ‘causing death by negligence’ carrying a potential sentence of up to 15 years, and ‘trafficking in adulterated or misbranded food products’ which could result in a maximum of 5 years in prison.
