Legal Fee Tariffs in Judicial Proceedings Published in the Official Gazette
The legal fee tariffs in judicial proceedings have been recently published in the Official Gazette, outlining the necessary fees and charges that parties involved in legal proceedings must adhere to. These fee tariffs aim to streamline the process and ensure fair compensation for various services rendered during the legal process.
According to the fee tariff regulations, when filing a lawsuit, the plaintiff is required to deposit a mandatory advance fee to the court treasury. This advance fee is determined as the total of 400 Turkish lira for other tasks and procedures, along with a notification fee five times the number of parties involved. Any unused portion of the advance fee under the notification scope will be refunded to the plaintiff after the final judgment is made.
In cases where temporary legal protection is requested, any unused portion of the advance fee will be refunded to the plaintiff upon request after the decision is rendered. These regulations aim to ensure transparency and fairness in legal proceedings by providing clear guidelines for fee structures.
Arbitration Fees Set
In cases where disputes are resolved through arbitration under the Law on Civil Procedure, the fees for arbitrators have been established to facilitate a fair and efficient resolution process. When parties cannot reach an agreement on the fee or if the arbitration agreement does not specify a provision for fees, the arbitrator or arbitration board will be entitled to receive a fee of up to 500,000 Turkish lira.
For disputes where only one arbitrator is appointed, a fee of 5% will be charged, while disputes requiring three or more arbitrators will incur a fee of 8%. These fees will be applied at a rate of 4% for each additional 500,000 lira beyond the initial 500,000 lira for a single arbitrator, and 7% for three or more arbitrators.
In cases involving disputes worth 10 million lira or more, the fee for a single arbitrator will be 0.1%, while disputes requiring three or more arbitrators will incur a fee of 0.2%. These fees are intended to compensate arbitrators for their time and expertise in resolving complex legal disputes.
Witness Fees and Expenses
In legal proceedings, witnesses play a crucial role in providing testimony and evidence to support the case. To ensure fair compensation for their time and efforts, witnesses will be entitled to receive a fee ranging from 100 to 150 Turkish lira, depending on the duration of their testimony.
If a witness is required to travel for the proceedings, their accommodation and meal expenses will also be covered. It is important to note that the fees and expenses paid to witnesses are exempt from any taxes, fees, or charges, ensuring that they receive fair compensation for their contributions to the legal process.
Overall, the publication of legal fee tariffs in the Official Gazette aims to provide clarity and transparency in the legal system, ensuring that all parties are fairly compensated for their services and contributions to the judicial process. These regulations help maintain the integrity of the legal system by establishing clear guidelines for fee structures and compensation, ultimately promoting a fair and efficient resolution of legal disputes.
